The Privacy Policy regulates the procedure for ensuring the security of Personal/Statistical data when using Falconsair Services.
In this document, we describe how we collect, process, store, disclose and transmit Personal/Statistical Data when receiving Falconsair Services.
The provisions of this Privacy Policy apply only to Personal Data collected by the Platform in the ways described in its terms and conditions.
References to the words “You” or “Your” (or words similar in content) mean the User, depending on the context of the Privacy Policy.
The Privacy Policy applies only to Personal Data, which is collected by the System.
References to “we”, “our” or “us” (or similar words) mean the Falconsair Platform.
The words he/she and their derivatives in the text of a document can be applied to either a male or female person, depending on the context of the document.
1 DEFINITIONS
- 1.1 User is any natural person who orders Goods on the Platform website and whose Personal Data is processed by the Platform during the provision of Services.
- 1.2 User consent (hereinafter referred to as “Consent”) is a voluntary, specific, informed and unambiguous expression of will in which the User, through a statement or clear positive action, agrees to the processing of his Data.
- 1.3 Goods are products placed on the Site for sale to the User
- 1.4 Personal Data - is any information that is in the public domain, allowing you to directly or indirectly identify the User. For example, first name, last name, phone number, IP address.
- 1.5 Statistical Data is any information that is publicly available and directly or indirectly relates to the User. For example, information about the name or address of the User's company.
- 1.6 Data is the general name for Personal and Statistical Data.
- 1.7 "Falconsair" platform (hereinafter the "Platform" or "Falconsair") is a service created for the sale of Goods to the User.
- 1.8 Website of the "Falconsair" Platform (hereinafter referred to as the "Site") means a web page or group of web pages on the Internet, which are located at: https://in.betli.shop/, through which the Platform provides Services.
- 1.9 Services are an algorithm of actions performed by the Platform to provide the User with the opportunity to purchase Goods.
- 1.10 Controller means a natural or legal person, government agency, institution or other body that independently determines the purposes and means of processing Personal and Statistical Data.
- 1.11 Processor means a natural or legal person, public authority, agency or other body processing Personal and Statistical Data on behalf of and on behalf of the Controller.
- 1.12 Third Party means a natural or legal person, government agency, institution or body, other than the User, Controller, Processor or Platform, and persons authorized by the Controller or Processor under their direct supervision to process Personal and Statistical Data

- 2.1 WThe Platform acts as a Processor of the Data it receives from the User in the ways specified in this Privacy Policy, and the User acts as a Controller.
- 2.2 The Platform is not responsible for the processing of Personal and Statistical Data by any third parties that are not controlled or owned by Falconsair.
- 3.1 The Platform may receive the following Personal Data about the User:
- 3.1.1 full name;
- 3.1.2 e-mail;
- 3.1.3 password;
- 3.1.4 payment details, only for receiving payment for the sold and other mutual settlements;
- 3.1.5 contact phone number used to communicate with the Platform.
- 3.2 The Platform can receive the following Statistical Data about the User-legal entity:
- 3.2.1 information about the company: name, legal address, form of business activity, country of registration and operation, IBAN, field of activity, information about employees and management;
- 3.2.2 registration/tax number/register code;
- 3.2.3 contact details: phone number, email;
- 3.2.4 payment/banking details solely for receiving payment for the Services;
- 3.2.5 information about employees that is publicly available.
- 3.3 The Platform informs that payment data (bank card number, date and CVV code, etc.) are processed exclusively by the payment service/bank that provides payment processing services to the Platform.
- 3.4 The Platform may collect Data when communicating with the User and providing Services received through social networks, instant messengers, and email. In such case, such data will be processed in accordance with this Privacy Policy.
- 3.5 Falconsair does not collect or process sensitive Personal Data of the User, such as race or ethnicity, gender, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, information about health, sex life or sexual orientation.
- 3.6 When using the Site or receiving Services, the Platform may automatically collect the following
Data:
- 3.6.1 IP address;
- 3.6.2 setting time zone and language;
- 3.6.3 operating system, device type and screen extension;
- 3.6.4 the country where you are located;
- 3.6.5 data about your visit to the Site, including full URL information, navigation routes to the Site and when going to/exiting the Site (including date and time), page response time, data loading errors, length of stay on certain pages, activity on the page (such information such as scrolling and mouse movements, clicks), methods used to exit the page and telephone numbers used to contact the customer service center.
- 3.7 The Platform has the right to collect and receive Personal and Statistical Data of the User in
the following ways:
- 3.7.1 when providing Services;
- 3.7.2 when interacting with the User;
- 3.7.3 when interacting with Platform employees by exchanging emails/notifications, communicating with Platform employees;
- 3.7.4 when monitoring and evaluating the User’s actions to identify and prevent fraud;
- 3.7.5 use of log files, cookies and other tracking technologies;
- 3.7.6 using instant messengers and social networks.
- 3.7 The Platform has the right to use Personal and Statistical Data for the following
purposes:
- 3.8.1 provision of Services;
- 3.8.2 to ensure the security of the Site;
- 3.8.3 to administer the Site and conduct internal operations, including troubleshooting, data analysis, testing and completing surveys;
- 3.8.4 to improve navigation of the Site;
- 3.8.5 communication with the User;
- 3.8.6 responding to requests from law enforcement agencies;
- 3.8.7 to initiate responses to legal claims, investigations or resolution of disputes with you.
- 4.1 Falconsair may transfer Data to entities with which the Platform cooperates in the
implementation and provision of Services:
- 4.1.1 Payment service/bank. To carry out mutual settlements with the User, the Platform may transfer their Data to the payment service/bank.
- 4.1.2 Contractors and employees The Platform may transfer your Personal and Statistical Data to other persons with whom it enters into cooperation, including legal and tax consultants, as well as persons providing accounting, logistics, marketing and IT services.
- 4.1.3 Counterparties. The Platform has the right to disclose or transfer Personal and Statistical Data in the following transactions: acquisition or merger, financing, corporate reorganization, joint venture, including sale of assets or bankruptcy.
- 4.1.4 Courts, law enforcement and government agencies. The Platform has the right to transfer Personal and Statistical Data when fulfilling any legal obligations, including by court order.
- 5.1 One of the following actions by the User means Consent with the terms of this Privacy
Policy:
- 5.1.1 receiving Services;
- 5.1.2 buying Goods;
- 5.1.3 registration on the Site;
- 5.1.4 agreement with the Privacy Policy.
- 5.2 By agreeing to the terms of this Privacy Policy, the User provides his Consent to:
- 5.2.1 use and processing of his Personal and Statistical Data in accordance with the terms of the Privacy Policy;
- 5.2.2 providing the Platform with additional information and Data upon its request;
- 5.2.3 processing of his payment details by the payment service/bank in accordance with the terms of this Privacy Policy;
- 5.2.4 processing of his Data during the purchase of Goods;
- 5.2.5 processing of his payment details by the payment service/bank in accordance with the terms of this Privacy Policy;
- 5.2.6 transfer of his Data to third-party services in accordance with the terms of this Privacy Policy.
- 5.3 The Platform reserves the right to obtain User Consent through a pop-up form. The pop-up form may contain a Consent form in the form of a checkbox.
- 6.1 The Platform uses all necessary security and Data protection measures to ensure its confidentiality and prevent loss or unauthorized disclosure.
- 6.2 The Platform protects and stores Data from:
- 6.2.1 losses;
- 6.2.2 unlawful use, transfer, disclosure, modification, deletion and/or destruction.
- 6.3 Falconsair has the right to retain Data for a period of 3 (three)
years after termination of the relationship in the following cases:
- 6.3.1 for statistical accounting;
- 6.3.2 if current legislation requires their storage;
- 6.3.3 if they are necessary to conduct business;
- 6.3.4 if they are necessary to conduct business;
- 7.1 The Platform processes Data on the following legal grounds:
- 7.1.1 User Consent;
- 7.1.2 registration on the Site;
- 7.1.3 purchase of Goods;
- 7.1.4 provision of Services.
- 7.2 In cases where the basis for the processing of Data is your Consent, you have the right to withdraw it at any time. To revoke your Consent, you may send an email to:[email protected] If your Consent is revoked, the Platform has the right to stop providing the Services and terminate all relations with you. If Consent is revoked, your Personal and Statistical Data will be deleted permanently.
- 7.3 The Platform undertakes to stop processing Personal and Statistical Data within 15 (fifteen) business days from the date of receipt of the withdrawal of Consent.
- 8.1 When processing Personal Data, Falconsair provides the User with the following
rights in accordance with the General Data Protection Regulation:
- 8.1.1 Right of access. The User can contact us directly to gain access to the Personal and Statistical Data we store about him, as well as any information.
- 8.1.2 Right to erase.The User has the right to delete Personal and Statistical data about himself. In this case, Personal and Statistical data will be permanently deleted.
- 8.1.3 Right to Data portability.We may transfer the User's Personal and Statistical Data to Third Parties.
- 8.1.4 Right to correction. The User has access to Personal and Statistical data, which at any time requires updating, correction and addition.
- 8.1.5 Right to restriction. The User has the right to object to the processing of his Personal and Statistical Data at any time.
- 8.1.6 Automated individual decision making, including profiling. The User has the right not to be subject to a decision based solely on automated processing of his Personal and Statistical Data, including profiling, which has legal consequences for him or which similarly has a significant impact on him.
- 9.1 This section applies to residents of the Republic of India. The processing of Data from residents of the Republic of India is regulated by the following legislation: Digital Personal Data Protection Act, 2023.
- 9.2 During Data processing, the Platform acts as a Data Fiduciary.
- 9.3 The Platform processes User Data exclusively on the following grounds:
- 9.3.1 User Consent;
- 9.3.2 for legitimate business purposes.
- 9.4 The Platform processes User Data for the following reasons:
- 9.4.1 for a specific purpose (business purposes), in accordance with the Consent of such User;
- 9.4.2 based on the terms of this Privacy Policy;
- 9.4.3 to fulfill its obligations to the User;
- 9.4.4 to fulfill their obligations to state bodies;
- 9.4.5 for the execution of court decisions;
- 9.4.6 to fulfill the requests of state bodies.
- 9.5 At the User's request, the Platform provides him with the following information:
- 9.5.1 a summary of the Data processed by the Platform;
- 9.5.2 identification data of all other authorized persons and data processors who process the User's data;
- 9.5.3 any other information related to the Data processed by the Platform.
- 9.6 A User shall have the right to correction, completion, updating and erasure of his Data for the processing of which she has previously given consent, in accordance with any requirement or procedure under any law for the time being in force.
- 9.7 Platform shall, upon receiving a request for correction, completion or updating
from a User:
- 9.7.1 correct the inaccurate or misleading Data;
- 9.7.2 complete the incomplete Data; and
- 9.7.3 update the Data.
- 9.8 A User shall perform the following duties, namely:
- 9.8.1 to comply with the provisions of all applicable laws for the time being in force while exercising rights;
- 9.8.2 to ensure not to impersonate another person while providing her Data for a specified purpose;
- 9.8.3 to ensure not to suppress any material information while providing his
- 9.8.4 Data for any document, unique identifier, proof of identity or proof of address issued by the State or any of its instrumentalities;
- 9.8.5 to ensure not to register a false or frivolous grievance or complaint with a Platform;
- 9.8.6 to furnish only such information as is verifiably authentic, while exercising the right to correction or erasure.
- 10.1 Falconsair makes every effort to process Personal and Statistical Data lawfully in accordance with international standards for the processing of Personal and Statistical Data.
- 10.2 This Privacy Policy contains the main legal acts related to the processing of personal and statistical data.
- 10.3 Unfortunately, we cannot list all the laws regarding the processing of Personal and Statistical Data in every jurisdiction in the world.
- 10.4 The terms of this Privacy Policy describe the basic rights of the User provided for by the main provisions of the main legislative acts governing the processing of Personal Data.
- 10.5 If you believe that the provisions of this Privacy Policy violate and/or in any way limit your Data processing rights, please contact us by email at [email protected] and we will do our best to resolve the problem within a reasonable time.
- 11.1 The User has the right to submit a request to the Platform if he believes that his rights have been violated by writing a request in writing to Platform support at the address:[email protected].
- 11.2 The User's request must contain reliable information about the requirements for the Platform. If the request does not specify the exact requirements, the Platform has the right to refuse to fulfill the request.
- 11.3 We will not be able to respond to your request or provide you with Personal and Statistical Data unless we can verify your identity and confirm that the Personal and Statistical Data belong to you. If a request is received with false information and/or if it is impossible to confirm the User’s identity, the Platform has the right not to process the received request and contact the User for clarification. If a response to a request for clarification is received, the User must provide a new corrected request or submit a new request.
- 11.4 The Platform is obliged to respond to the request or fulfill the conditions set forth in the request within 15 (fifteen) business days from the date of its receipt.
- 12.1 The Platform informs the User that Personal and Statistical Data may be used to provide the Services, and, in case of disagreement with this, the User is not entitled to receive the Services.
- 12.2 The Platform is not responsible if the User provides inaccurate Personal and Statistical Data, including the inability to receive Services.
- 12.3 The Platform is not responsible for any losses caused to the User as a result of the use of his Personal and Statistical Data by a Third Party without his knowledge, including third-party services (partners, payment systems, web analytics services, etc.), since his Personal and Statistical Data are processed in in accordance with the privacy policy of such services.
- 12.4 The Platform may link to other websites or services. The Privacy Policies of these websites and services are not governed by the terms of this Privacy Policy, and the Platform cannot be responsible for the Data handling of third party websites and services.
- 12.5 Falconsair is not responsible for:
- 12.5.1loss of Data in the event of a hacker attack, hacking of the Platform or Site software, unlawful actions of Third Parties, as well as actions that violate the terms of the Privacy Policy;
- 12.5.2impossibility of providing Services or poor quality provision of Services if the User provides false Data or any other information;
- 12.5.3impossibility to receive the Goods due to incorrectly specified Data.
- 12.6 Unfortunately, the transmission of information over the Internet cannot be completely secure. Although we make every effort to protect Data, we cannot guarantee a secure transmission of Data to the Site. In this regard, you are solely responsible for possible failures in the transfer of your Data to the Platform.
- 13.1 Cookies do not transmit viruses and/or malware to your device because the data in Cookies does not change during transmission and does not affect the performance of the device. They are more like logs (i.e., they record User actions and remember status information) and are updated whenever You visit the Site.
- 13.2 When providing the Services, we may use the following types of Cookies:
- 13.2.1 Session Cookies. also known as temporary Cookies, exist only in temporary memory while the User is on a page of the Site. Browsers typically delete session Cookies after the User has closed the browser window.
- 13.2.2 Persistent Cookies are deleted on a certain day or after a certain period of time. This means that information about Cookies will be transmitted to the server every time the User visits the website to which these Cookies belong.

- 13.3 The Platform uses Cookies for the following purposes:
- 13.3.1 authentication and identification;
- 13.3.2 conducting web analytics;
- 13.3.3 marketing analytics research;
- 13.3.4 research of User preferences;
- 13.3.5 storing personal preferences and settings;
- 13.3.6 tracking access sessions;
- 13.3.7 storage of Statistical Data;
- 13.3.8 Site analysis.
- 13.4 The Platform can use the following web analytics services:
- 13.4.1 Google Analytics;
- 13.4.2 Own web analytics.
- 13.5 In many cases, web browsers allow Cookies to be stored on the User's end device by default. Site Users can change Cookie settings at any time in such a way as to block the automatic processing of Cookies or to report each time they are placed on the Site User's device. - 14.1 The Platform Services are intended for persons over eighteen years of age. The Platform does not process Data of persons under this age.
- 14.2 The Platform has the right to delete Data of a person under eighteen years of age, without warning or any consequences for the Platform, and also to stop providing Services to such a person.

- 15.1 We have the right to periodically make changes to the Privacy Policy for the security of Personal and Statistical Data, and to comply with the requirements of the laws of the Republic of Indonesia.
- 15.2 The User must familiarize himself with the new terms of the Privacy Policy and Falconsair is not responsible if the User has not familiarized himself with the new terms of the Privacy Policy.
- 15.3 Falconsair will update the modification date of the current version of the Privacy Policy in the “Updated” line at the top of the document.
- 15.4 Our electronic copies of the Privacy Policy are deemed to be correct, complete, valid, legally binding and in effect at the time of your visit to the Site.
- 16.1 The User has the right to contact the Platform support service at: [email protected] to ensure his rights, in accordance with the terms of this Privacy Policy, or in case of violation of his rights, or to leave feedback or ask a question.
